Pre-launch version: pricing, subscription renewal, cancellation and digital-delivery choices must be finalised in the checkout before commercial sales begin. Registered business details must also be added before launch.
1. About HyperLap
HyperLap is sim-racing software developed and provided by FD Customs. It combines available simulator telemetry, race context, voice interaction and AI-generated responses. These terms apply to the HyperLap website, account system, license services and software made available by FD Customs.
HyperLap is intended for entertainment and training in racing simulations. It is not a safety-critical system and must not be used for real-world vehicle operation or motorsport decision-making.
2. Accounts
- You must provide accurate account information and keep your login details secure.
- You remain responsible for activity performed through your account unless caused by FD Customs.
- You must notify support@fd-customs.nl if you suspect unauthorised access.
- Accounts may not be sold, shared or used to bypass license restrictions.
3. Software license
When a valid HyperLap license is assigned or purchased, FD Customs grants the customer a limited, personal, non-exclusive and non-transferable right to install and use HyperLap for its intended purpose, subject to these terms.
You may not copy or distribute HyperLap except for a personal installation or backup permitted by law. You may not sell, sublicense, rent, publicly redistribute, circumvent license checks, interfere with the licensing service, or reverse engineer the software except where applicable law expressly permits this despite these terms.
Ownership of HyperLap, its code, branding, interface and other intellectual property remains with FD Customs or the applicable rights holder. A license is permission to use the software; it is not a transfer of ownership.
4. Device activation
One HyperLap license may have one active computer at a time. Re-downloading or reinstalling HyperLap does not consume the license permanently.
You can deactivate the current computer through your HyperLap account and activate the license again on the same or another computer. Automated or excessive activation attempts may be temporarily restricted to protect the service from abuse.
5. Alpha, beta and pre-release builds
Builds described as alpha, beta, preview, test or pre-release may be incomplete and may contain defects, compatibility problems, changing features or data-loss risks. Features shown in a pre-release build are not a promise that they will appear unchanged in the final product.
Testers should keep appropriate backups, install only builds they trust and report defects without publicly disclosing private security or license information. Any separate tester agreement supplied with a build also applies.
6. Plans, prices and payments
HyperLap may offer monthly, annual and lifetime licenses. Final availability, prices, taxes, included features, renewal behaviour and cancellation options will be shown before purchase and in the order confirmation.
A lifetime license means a license for the supported lifetime of the purchased HyperLap product version or service, subject to these terms. It does not guarantee that every third-party simulator, AI service or online dependency will remain available indefinitely.
Once checkout is enabled, payments may be processed by Mollie. A payment is not considered completed until it has been verified server-side. Customers must not rely only on a browser success page as proof of payment.
7. Consumers, withdrawal and refunds
Consumers retain all mandatory rights provided by applicable law. For distance purchases, a statutory cooling-off period may apply. Special rules apply when digital content is supplied immediately.
If FD Customs asks a customer to receive a download or digital service during the cooling-off period and to acknowledge the resulting loss or limitation of the right of withdrawal, this will be requested explicitly before delivery and confirmed after purchase. If those legal steps are not completed, the customer's statutory rights remain unaffected.
Nothing in these terms removes legal remedies for digital content or services that are faulty, not as described or not supplied as agreed. Refund requests can be sent to support@fd-customs.nl.
8. Updates and compatibility
HyperLap depends partly on operating systems, simulator telemetry interfaces and third-party services. Updates to those systems can affect compatibility. FD Customs may release reasonable technical, compatibility, security and feature updates.
Supported simulators and system requirements are those stated on the website or supplied with the relevant build. Le Mans Ultimate is the initial focus, but compatibility may differ between simulator or HyperLap versions.
9. Availability and changes
FD Customs aims to provide a reliable service but cannot promise uninterrupted availability. Maintenance, faults, internet disruption, third-party changes or security incidents may temporarily affect accounts, AI services, downloads or license validation.
Material changes that negatively affect a paid ongoing service will be communicated where reasonably possible and handled in accordance with applicable consumer law.
10. Suspension and termination
A license or account may be temporarily suspended where reasonably necessary to investigate payment problems, security risks, misuse or a breach of these terms. A license may be revoked for serious or repeated abuse, fraud, unlawful distribution, chargeback fraud or deliberate circumvention of license controls.
FD Customs will not use suspension or revocation to remove mandatory consumer rights. Customers who believe action was taken incorrectly can contact support.
11. Liability
HyperLap provides informational and coaching output based on available data. Telemetry may be incomplete or delayed, and AI-generated responses may be inaccurate. You remain responsible for how you drive and configure the simulation.
To the maximum extent permitted by law, FD Customs is not liable for indirect or consequential losses, lost race results, lost gameplay data or losses caused by unsupported modifications or third-party outages. Nothing in these terms excludes liability that cannot legally be excluded, including mandatory consumer protections.
12. Privacy
Personal data is handled as described in the HyperLap Privacy Policy.
13. Applicable law and complaints
These terms are governed by Dutch law. If you are a consumer, this choice does not remove mandatory protections available under the law of your country of residence.
